O Código Penal vigente no Brasil foi criado pelo decreto-lei nº 2.848, de 7 de dezembro de 1940 pelo então Presidente Getúlio Vargas, tendo como Ministro da Justiça Francisco Campos. Apesar da criação em 1940 o atual Código só entrou em vigor no dia 1º de janeiro de 1942 (artigo 361).
